July 6, 2020 President's Message

Dear Members:

As we prepare for the COVID Forms Training beginning tomorrow, the following is a brief description or "cheat sheet" for the use of the forms and guidelines for your convenience.

1. GAR FORM RLA-CAA (Listing Agreement Coronovirus Addendum or Amendment)
Who is it for?
Sellers, Landlords and Brokers
What does this pertain to?
Listing agreements (new and existing)
What is it exactly?
It's an addendum to the listing agreement.  It informs the owners of the potential risks associated with having their property shown as well as the steps we as REALTORS(R) will take prior to, during or after a showing.  This is to include screening of both showing agent and their customers.
Is this a mandatory form?
YES.  However it does not need to be uploaded on the MLS. At the discretion of the broker, it needs to be kept with the property file or as broker determines.

2. GAR FORM PEAD (Coronavirus Property Entry Advisory and Declaration)
Who is it for?
Buyers, Renters and REALTORS(R) 
What does it pertain to?
Showing safety in relation to Coronavirus
What is it exactly?
A declaration for all those entering a subject property for a showing stating that they understand the risk of exposure of the Coronavirus, that they understand the governor's orders must be followed and that they are not (to the best of their knowledge) a carrier of the virus.
Is this a mandatory form?
YES. It is retained by the buyer/tenant agent and is not uploaded on MLS nor submitted to the listing agent.  It will be kept with the buyer/tenant agent at the direction of his/her broker.

3. GAR Property Entry Rules (Video and flyer)
Who is it for?
Sellers, Landlords, potential Buyers, potential Tenants and REALTORS(R)
What does it pertain to?
Listings and conduct of those entering a property.
What is it exactly?
A list of rules when entering a property that must be followed.  It is a reminder to sign the Form PEAD, wear a face mask, practice social distancing and the like.
Is this a mandatory form?
YES.  This flyer must be placed at either the main entry or access points of the property,

4. GAR Form COVID19 (COVID19 Addendum)
Who is it for?
Sellers, buyers and REALTORS(R)
What does it pertain to?
Purchase agreements (those affected by COVID)
What is it exactly?
It is an addendum to the purchase agreement stating that due to COVID19, timeframes may not be met because of Government mandated quarantines, emergency declarations and/or closures of non essential businesses as determined by the government.   This has the possibility of affecting inspections, appraisals, repairs, survey and etc. It also states estimated closing time after quarantine or a date determined by the lender.
Is this a mandatory form?
No.  This form is used as the direction of the buyer's broker.

5. Best Practices Guidelines and Supplement to GAR Best Practices Guidelines
Who is it for?
REALTORS(R)
What does it pertain to?
Best practices for REALTORS(R) when conducting any real estate activity
What is it exactly?
It is a list of guidelines on how to safely conduct day to day real estate activity with the current pandemic situation. It further supplies additional information and resources for all REALTORS and third parties.
Is this a mandatory form?
NO.  It is a list of suggested guidelines.

6.  SAMPLE PREPAREDNESS PLAN FOR CIRCUMSTANCES RELATED TO COVID-19
Who is it for?
REALTORS(R)/Brokers/Staff
What does it pertain to?
Possible cases of contact, either direct or indirect with persons who are positive for covid or who have been to areas that are considered high risk areas.
What is it exactly?
It is a sample guideline to follow in the event someone comes in contact with a person who tests positive, have come from a place that is considered a high risk area, or if someone in the office test positive or if that individual himself/herself test positive for the Coronavirus
Is this a mandatory form?
No.  It is a sample preparedness plan that is to be utilized at the discretion or direction of the broker.

The GAR office has uploaded the latest approved COVID forms on the GAR website.  Information may change quickly and as much as we will do our best to keep up with all the changes, it is incumbent upon each of us to practice safety and work responsibly.  

Please make sure to attend ONE of the Townhall training sessions as not only is it mandatory but they are information filled sessions to best prepare us during this still turbulent time.
